  1. Terms and Conditions
    1. Welcome to BidorBuyGolf.com the online golf auction site. Please note that “We” or “Us” means Worldwide Golf LTD and “You” means the registered person as detailed below, herein after jointly referred to as the “Parties”.
    2. This document (together with all documents contained and/ or referred to herein) contain the terms and conditions with which we contract with you via our website.
    3. These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and you and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract. Each of us agrees that our only liability in respect of those representations and warranties that are set out in this agreement (whether made innocently or negligently) will be for breach of contract. Nothing in this clause limits or excludes any liability or fraud.
    4. On registration you will be required to tick a box to confirm that you have read and accept these terms and conditions, and are over 18 years of age. If you refuse to accept these terms and conditions you will not be able to register or take part in any auctions or purchases on our site.
    5. Notwithstanding 1.3 above by using our site you indicate that you accept our terms and conditions, even though you may not participate in any auction or purchase. For your reference we suggest that once you have accepted our terms and conditions and intend to participate in an auction or purchase, that you print a copy for your reference.
  2. About Us
    1. We are Worldwide Golf LTD; a limited company incorporated in England under the company number 9749471. Our registered company address is Millfarm, Sandholme Road, Eastrington, East Yorkshire, DN14 7QQ. We operate this website.
  3. The Registered User
    1. You are free to browse our website prior to registration. However, before you can take part in any bid or purchase you must register on our site. Registration is free and on registration you must provide us with the information listed below. On confirmation that you have read and accepted our terms and conditions and by ticking the terms and conditions box and correctly entering the verification code we will create your account and your account details will be sent to your registered email address.
    2. The information we require is:
      1. Username – You must choose a username and this user name should not offend nor infringe on the rights of any third party. The username must not advertise any other website and we reserve the right to change or delete any username which we consider to be inappropriate or in breach of these terms and conditions.
      2. Password – You must keep your password secret and you will be responsible for any activity that is undertaken using the username and the associated password.

    3. We reserve the right to verify your identity as a user of our site. If we are unable to verify or authenticate your identity then we may request that you provide documentation including but not limited to your passport and or driving licence.
    4. The username together with the associated password from your account which is not transferable.
    5. Once you have registered you are free to continue browsing our site and there is no commitment to place a bid or make a purchase. However, once you place a bid or purchase you declare that:
      1. You are legally capable or entering into bid contracts;
      2. You are at least 18 years old;
      3. You hold a current valid credit/ debit card;
      4. You are a permanent resident in the country in which you hold the current valid credit/ debit card; and
      5. You agree to fully indemnify and keep us fully indemnified if any of the information and declared in 4.1.1 through to 4.1.4 above to prove too untrue.
  4. The Bidding Process
    1. Once you have successfully registered and activated your account you may take part in any auction subject to these terms and conditions and any further condition or restriction listed within each auction itself.
    2. In order to bid you will have to purchase bids; payment of these bids may be made through your credit/ debit card via PayPal. Should your payment not be honoured we will charge a return payment fee and you will be responsible for these fees.

      We do not accept responsibility for any direct or indirect damages or consequential losses suffered by use of fraudulent or unauthorised credit/ debit cards and we exclude liability for the same to the fullest extent possible by law.

    3. In order to bid you must select the reverse auction price of your choice from the prices available, enter your bid – which should reflect what you think is the lowest unique bid – and then click on the box marked “bid”. The bid fee will be deducted from your bids. You can review your account when bids have been placed but once a bid has been made it cannot be withdrawn.
    4. Bids only become valid when they are entered into our database and registered into our system. We are not responsible for disruptions in your connection and any errors that may occur because of this. This includes but is not limited to, non-browser response from your PC or connection failures, outdated software on your computer and/or connection interference between your computer and our servers.
    5. All bids are sealed and will only be made public following the end of an auction. The results will appear on our site within 72 hours of the end of the auction and we will disclose the username of each winning bidder on our site. Winning bidders of certain auctions, such as those with a high ticket value, may be requested to take part in a handover/ or promotional activities that may require the taking of pictures/ videos and used for our own promotional activities.
    6. Once the pre-determined maximum number of bids (“Bid Threshold”) for the relevant item has been reached or period of days has been passed (such period will be subject to the individual item), the auction will automatically close. The bidder with the lowest unique bid will win the auction and will receive notification of their win via email and/ or text.
    7. What is the lowest unique bid?

      No. Of Bids - Value

      15 bids- 1:10 Euro

      2 bids- 2:20 Euro

      1 bids - 3:50 Euro

      14 bids - 4:10 Euro

      20 bids - 5:80 Euro

      In this example 3 Euro is the lowest unique bid with only one person having placed that bid. If there is no lowest bid then the prize will be offered to the first bidder in the group of the lowest bid with the fewest number of bids. Again using the same example the first person to have bid 2 Euro would be the winner. Although 1 Euro is the lowest value it does not have the fewest bidders. The first bidder will be determined by the time at which the bid was entered into our database and registered into our system. Our decision to who is the first bidder is final.

    8. If the bid threshold is not reached within the specified days of the auction commencing, we may at our discretion, where the number of bids is equal to or more than 75% of the “Bid Threshold” (or such percentage as we in our absolute discretion deem appropriate) may either (a) award the item to the bidder with the lowest unique bid at that point; or (b) where there is no unique lowest bid, offer the item to the first placed lowest bid with the fewest amount of bids as explained above (e.g. referring to the example above, the first bid placed on the lowest amount (2 Euro) with only 2 bids); Where the number of bids is less than 75% of the “Bid Threshold” we may at our discretion either (a) award a cash prize (“Cash Prize” will be a percentage determined by us depending on the value of bids received at that time for the auction in question) to the bidder with the lowest unique bid at that point; or (b) where there is no lowest unique bid, offer the “Cash Prize” to the first placed lowest bid with the fewest amount of bids as explained above (e.g. referring to the example above, the first bid placed on the lowest amount (2 Euro) with only 2 bids)
    9. The winning bidder will be requested to respond within 14 days of the date the email and/or text notification was sent from us to confirm acceptance of their prize. The winning bidder will not be required to pay any further monies upon winning the auction including the winning figure that represents the lowest unique bid. There is no cash alternative available. If you choose not to accept the prize it will be offered to the next lowest unique bid. All unsuccessful bidders will receive a notification email and/or text message to this effect and by registering with our site you consent to receiving such notifications.
  5. Disqualification, Refunds and Termination
    1. Any abuse of the registered users account will result in termination of the account and the immediate disqualification from any future re-registration on our site. We may at any time, exercise at our sole discretion suspend or permanently exclude you from our site and its services. We will decide upon such expulsion if and in so far as, in our reasonable opinion, you have breached these terms and conditions, violated any laws or infringed upon the rights of third parties, or we have another justified interest or reason in such for protecting of other users or to prevent manipulation of any kind such as but not limited to, users colluding or several accounts being set up by you or the use of unauthorised bidding software.
    2. We reserve the right to disqualify you and/ or your bids(s) if we deem that you have unfairly won an auction. This includes but is not limited to collusion bidding. If you are disqualified you will not be liable to any return of any bid fees, or any other associated costs.
    3. We reserve the right to limit the number of auctions you may participate in and the number of auctions you may win per calendar month.
    4. You may at any time request the cancellation of your account by clicking on the button “Cancel my account”, which is found on your BidorBuyGolf home page when logged in.
    5. As the winning bidder and/ or consumer you may return any items won on auction and/ or chosen providing you notify us by email to info@bidorbuy_admin.com within 7 days of receipt of the items you wish to be returned and such items must be returned on notification. You are legally obliged to take reasonable care of the items whilst in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. Details of your statutory rights of cancellation, and an explanation of how to exercise it, are provided herein. This provision does not affect your other statutory rights as a consumer.
    6. If you return the items to us because you have cancelled the contract between us within the 7 day period referred to above, we will process the refund due to you within 30 days of the date on which you gave us notice of cancellation and we will refund the winning bidding fee for that auction and/ or the value of item purchased less any administration fee and credit card charges. The cost of returning the items will be for your account. We reserve the right to pay any refund by any reasonable method.
  6. Our Liability
    1. We cannot guarantee continuous access to our site, and operations of our site may be interfered with by factors out of our control. Whilst we will use our reasonable endeavours to maintain an uninterrupted service, we cannot guarantee this and do not give any promises or warranties (whether express or implied) about the availability of our services.
    2. We will not be responsible for any losses, damages or costs that you suffer when using our site and you agree to indemnify us from claims resulting from the use of our site. You agree at the use of our site is entirely at your own risk.
    3. Neither we, nor our service providers, agents, licensors or employees will be liable for any damages suffered by you or any other party as a result of the use and/ or misuse of our site.
    4. We will not be liable for faulty operation of your computer, nor incorrect or slow transmission of bidding date by internet providers. In the event that this does happen, you will have no legal right to the purchase / receipt of the items.
    5. Insofar as we are insured for our liability for any damage, we can at our discretion assign to you any insurance settlement and you will be obliged to accept this in full and final settlement.
    6. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (“Force Majeure Event”)

      A Force Majeure Event includes any act. Event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; the act, decrees, legislation, regulations or restrictions of any government; and technical, operational or server problems.

      Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or find a solution by which our obligations under the contract may be performed despite the Force Majeure Event

    7. In respect of any losses or damages arising under or in connection with any contract between us and you our total liability will not exceed the net price paid by you for any item, net of administration, credit card or returned payment fees.
  7. Disruption of Services
    1. In the event of a technical problem (third party or other) affecting our site’s auction platform, the countdown timers for all (or some) live auctions will be paused until the issue has been resolved. Auctions will continue once the system is brought back up. Should auctions close prematurely due to any technical problem, affected auctions may be restarted. The auctions’ countdown timers will be continued from the same point in time they were prior to the technical problem. Alternatively we reserve the right to start all auctions from the beginning, once the technical problem has been rectified.
    2. We may attempt to return purchased bids placed on the auctions that had to be paused then restarted from the beginning due to a third party technical problem.
    3. Should we suspect that an unlawful action(s) against its terms and conditions brought the service down; we have to right to investigate the matter and take legal action against the perpetrators.
  8. Notices
    1. We will contact you by email or provide you with information by posting notices on our site and as such you agree to that this electronic means of communication and acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.
    2. You may give notice to us at either the registered address stated in clause 1 or by email at info@bidorbuygollf.com. We may give notice to you at the email address you provided to us when registering or any of the means specified in 7.1 above.
    3. You will be deemed to have received notice when such notice is posted on our site, one hour after an email is sent, or 48 hours after the date of posting any letter. In proving the service of any notice on you, it will be sufficient to prove, in the case of an email that such email was sent to the specified email address of the addressee. Any notice given by you to us must be given to us by recorded first class post to the registered office address stated in the About Us above, or by email to info@bidorbuy_admin.com. We will be deemed to have received notice only at the time of actual receipt.
  9. Third Party Links
    1. You agree not to link any third party website(s) to any part of our site by means of hyperlink or otherwise without our prior written notice. Where consent is given you may link our home page, provided that this is done legally and will not damage our reputation or take advantage of it. You may not establish a link in such way as to suggest any form of association, approval or endorsement on our part; unless otherwise agreed.
    2. Where our site links to other website and resources provided by third parties, these links are provided for your information only. We have no control over the content of those sites or resources and accept no liability or responsibility for them or any damage that may arise from your use with them.
  10. Waiver
    1. If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under to contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 8 above.
  11. Severability
    1. In any of these terms and conditions or any provisions of a contract are determined by aby competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

      Notwithstanding the above paragraph the remaining clauses must reflect the original intention and spirit of the parties.

  12. Our right to vary these terms and conditions
    1. We reserve the right to revise and amend these terms and conditions from time to time without notice for any reason. Any revisions will be published on our site with reasonable prominence. You will be subject to the policies and terms and conditions in force at the time that you place a bid(s) and/ or purchase with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to bid(s) and/ or purchases previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the dispatch confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within 5 working days of receipt by you of the item).
  13. Transfer of Rights and Obligations
    1. You may not assign, transfer, change, subcontract or deal with any other manner your rights or obligations hereunder in whole or in part to any third party. A pe3rson who is not a party to any contract between you and us shall not have any rights, arising under or in connection with these terms and conditions.
  14. Law and Jurisdiction
    1. Any contract between you and us and any dispute or claim arising of such contract or these terms and conditions shall be governed by and construed according to UK law and the parties irrevocably submit to the exclusive jurisdiction of the UK courts.
